What is UCC Uniform Civil Code in India?

Uniform Civil Code in India: The Uniform Civil Code (UCC) is a proposed legislation in India that aims to replacing  personal laws applicable to all individuals, irrespective of their sexual orientation, gender or religious affiliation. Currently, personal laws are governed by religious specific to different communities.

Uniform Civil Code

Uttarakhand is the first state in  India to pass the UCC (Uniform Civil Code)  through its state assembly. It aims to govern and manage the laws  marriage and divorce, succession, live-in relationships and matters in uttarakhand .

The Uniform Civil Code (UCC) Uttarakhand

The Chief Minister of Uttarakhand, Pushkar Singh Dhami, introduced a new law The Uniform Civil Code (UCC) in the state’s assembly. This law has for marriage, divorce, property and land, for everyone who lives in Uttarakhand, no matter what religion they follow, except for Scheduled Tribes.

Key Points of UCC (Uniform Civil Code)

  1. The UCC Bill have a proposes of uniform law on marriage, divorce, inheritance of property, and cohabitation for all citizens, regardless of their religious, while excluding the tribal community from its scope.
  2. This arise from Article 44 of the Constitution, which driection that the state “shall effort to secure for the citizens a UCC(Uniform Civil Code) throughout the territory of India.
  3. The provision is a part of the Directive Principles of State Policy (Part IV of the Constitution of India ), which although not enforceable but play a pivotal role in the country’s governance.
  4. The Bill aims to conduct the live-in relationships by imposing an obligation to register them.
  5. In case, couples in a live-in relationship do not submit their statement, they will be served a notice which criminal prosecution can be initiated against them.
  6. Section 4 says that “neither party has a spouse living at the time of the marriage”, thus prohibiting polygamy or bigamy.
  7. Men and women have been grant similar rights with respect to divorce.
  8. Section 28 prohibits the initiation of divorce proceedings unless one year has go along since the date of marriage.
  9. However, An special case can be made if the petitioner has suffered “exceptional hardship” or if the respondent has exhibited “exceptional depravity”.
  10. Existing Muslim personal law practices governing marriage and divorce such as nikah ,halala, iddat and triple talaq have been criminalized under the Bill without express naming them.
  11. The UCC Bill extends equal property rights for Sons and Daughters across all classes.
  12. The Bill leaves out members of the LGBTQIA+ community from its ambit and applies only to heterosexual relationships.

UCC Bill key Highlights of Uttarakhand’s, 2024?

  1. The UCC (Uniform Civil Code) aims to replace personal laws of every religion, focusing on marriage, divorce, adoption, and inheritance, guided by Article 44 of the Constitution. This law would be a single set of personal laws that would apply to all citizens, regardless of religion.
  2. The UCC (Uniform Civil Code) Some of the proposals put  by the committee include the prohibition of polygamy, nikah, iddat ,halala (a mandatory period of waiting to be observed by women follow the dissolution of a Muslim marriage), triple talaq, and child marriage, uniform age for girls’ marriage across all religions, and mandatory registration of live-in relationships.
  3. The UCC Bill, Aims to focus on gender equality  men and women equally in matters such as inheritance and marriage.
  4. The law is also l to extend an equal property share to Muslim women against the existing 25% share accorded under Muslim personal laws.

Marriage Registration Under UCC (Uniform Civil Code)

According to the UCC (Uniform Civil Code) Bill , the age for marriage will be 18 for women and 21 for men in all communities. Marriage registration Mandatory is also stipulated in all religions, and marriages without registration will be deemed invalid. No divorce petition will be permitted to be filed within one year of marriage.
